Booking Agreement

This booking request form constitutes a legally binding contract entered into by you, herein referred to as "the Purchaser", 5th Element Entertainment, herein referred to as "the Agency", and the designated artist, herein referred to as "the Artist", collectively referred to as "the Parties", for the event as described herein.

The Parties hereby agree to adhere to and be bound by the terms and conditions set forth in this agreement.

The Agency and the Artist collectively commit to performing their respective obligations as detailed within this agreement, in accordance with all applicable laws and regulations.

A 50% Non-refundable Deposit is required to guarantee Performance/Speaking date.

Booking Agreement Terms & Conditions

Parties Involved: This agreement is legally binding between the following parties:

• The Purchaser: You
• The Artist: Designated Artist
• The Agency: 5th Element Entertainment

Performance Commitment: The Artist commits to providing the services as specified in the booking form for the event described. This includes adherence to the agreed performance type, duration, and event attire requirements.

Financial Obligations:

• The Purchaser agrees to pay the agreed honorarium and any additional travel expenses as specified in the form.
• A 50% non-refundable deposit is required at the time of booking to secure the event date.
• The remaining balance must be paid in full at least fourteen (14) days prior to the event.
• Payments must be made using one of the methods specified in the booking form.

Event Requirements: The Purchaser is responsible for ensuring that the venue is equipped with the necessary equipment and meets the requirements as listed in the booking form.

Cancellation and Rescheduling:

• In the event of cancellation by the Purchaser, the deposit will not be refunded.
• Rescheduling is subject to the Artist’s availability and may incur additional fees.

Liability and Force Majeure: Neither the Agency, the Artist, nor the Purchaser shall be liable for failure to perform their obligations if such failure is due to circumstances beyond their reasonable control, including but not limited to natural disasters, public health emergencies, significant government actions, legal restrictions, labor disputes, terrorist activities, infrastructure failures, and major transportation disruptions.

Conduct and Professionalism: All parties agree to conduct themselves with professionalism and respect throughout the duration of this agreement. This includes adherence to the event schedule and performance terms.

Amendments: Any modifications to this agreement must be made in writing and signed by all parties. Verbal agreements or understandings will not be considered binding.

Governing Law: This agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the event is being held.

Confirmation of Terms: By signing this agreement, the Purchaser acknowledges their understanding and acceptance of these terms and conditions, forming a binding contract between the Purchaser, the Artist, and the Agency.
